Staff handbooks are a very good way of bringing together in one place guidance for employees on a variety of issues. Unintended consequences can occur, however, if it is not clear whether all or any part of the handbook forms part of the contract of employment.
The Employment Rights Act 1996 requires all Employers to issue to their Employees, a Principal Statement of Terms and Conditions of Service. This document which is required to be issued within the first eight weeks of employment has to contain minimum information as defined by statute. It is very important therefore that if you do prefer to issue one document only that there should be two distinct parts, one clearly contractual and the other clearly not.
